Heard Mr. Pethe, learned Counsel appearing for the Petitioner and Mr. Kanoujia, learned Counsel appearing for the Respondent. 2.

At the outset, Mr. Pethe, learned Counsel states that the Petitioner has regularly paid the maintenance as directed by the impugned order dated 30th March 2024. He further states that, without prejudice to the rights and contentions of the Petitioner, if the proceedings pending before the Family Court are expedited, then he has instructions not to press the present Writ Petition.

Mr. Kanoujia, learned Counsel appearing for the Respondent states that the Respondent has also filed a Petition under Section 9 of the Hindu Marriage Act, 1955, seeking restitution of conjugal rights. 4.

Perusal of the record shows that the Petition seeking divorce bearing Petition A/8/2019 is pending for last about 6 years. In the facts Vaibhav Page No. 1

909-WP-15138-2024.doc and circumstances, the learned concerned Judge of Family Court, Thane is requested to dispose of said Petition A/8/2019 expeditiously along with said Petition filed for restitution of conjugal rights within a period of 18 months, however, by taking into consideration the pendency of the other Petitions.

Accordingly, the Writ Petition is disposed of in above terms, with no order as to costs.
