The Petition is moved before the Vacation Court on account of letter dated 11 October 2024 issued by the Circle Officer, Igatpuri, proposing to implement the order passed by the Tahsildar, restoring the land in favour of the Tribal person. Though Petitioner's Appeal had been rejected by the Additional Divisional Commissioner, Nashik by order dated 31 August 2023, Petitioner has preferred a Revision before the State Government, which is pending. It appears that during pendency of Appeal before the Additional Divisional Commissioner, Nashik, interim order was passed in favour of the Petitioner on 22 February 2023. On account katkam Page No.

k 2/2 5 wp 15307.24 as.doc of dismissal of the Appeal by order dated 31 August 2023, the said interim order has come to an end. The anxiety of the Petitioner is that the impugned order of the Tahsildar would be implemented by the Circle Officer during the pendency of a Revision before the State Government.

We could have disposed of the Petition by directing the State Government to decide the Revision Petition in a time bound manner and by staying the impugned order of the Tahsildar in the mean time. However, the affected parties are not before us as of today. Accordingly, issue notice to Respondent No.2, returnable on 27 November 2024.
