We have heard the learned Senior Advocate for the Petitioner and the learned Addl. G.P. None present for Respondent Nos. 4, 5 and 6, though served.

The learned Addl. G.P. submits that Respondent No. 2, before arriving at a final conclusion on the merits of the proposal, called for a report from Respondent No. 3. Thereafter, the Petitioner has

approached this Court. He submits that it is Respondent No. 2 who has to take a decision based on its investigation and a report of the Education Officer, which is yet to be submitted.

In view of the above, we direct that Respondent No. 3 would strictly adhere to the law applicable and submit his report to Respondent No. 2, within a period of 21 days from today. Thereafter, Respondent No. 2 would consider the inter se seniority between the employees concerned and, by following procedure laid down in law, shall deliver a decision with reasons within 30 days thereafter. Let such decision be communicated to the Management and Respondent No. 4, on its email address (idealhigh18@gmail.com) within 24 hours of the passing of the order.

Since the Petitioner voiced an apprehension that the management may not communicate the decision to him, Respondent No. 2 would post the decision by speed post A/D to the Petitioner or on the Petitioner's email address which reads as under : ramendrarao007@gmail.com 5.

With the above directions, this Petition is disposed off.

In the event, the proposal is refused, the aggrieved party is at liberty to avail of a remedy as is permissible in law. If the proposal is accepted, the Shalarth I/D be allotted expeditiously so as to commence the payment of salary.
