The Petition was listed yesterday for admission when this Court expressed that the Petitioner has alternate remedy of approaching the Maharashtra Administrative

2/3 2-Wp-15390-2024.doc Tribunal, Mumbai, and in fact an order to that effect was dictated. However, in another related Petition, this Court was apprised of the fact that the Vacation Court before the Tribunal would not be available before 04.11.2024. This is the reason why the order was not signed yesterday and the Petition has been placed before us today.

Ms. Malik the learned counsel appearing for the Petitioner would submit that in pursuance of the order dictated by this Court yesterday, the Petitioner immediately filed Original Application before the Tribunal and the same was moved before the Vacation Court of the Tribunal yesterday. However, she would inform that on account of the nonavailability of order dictated by this Court, the Tribunal has not passed any order in the Original Application. 3.

Ms. Kapadiya, the learned counsel appearing for the State of Maharashtra and the Maharashtra Public Service Commission, would invite our attention to the letter dated 29.10.2024 addressed by the Joint Secretary, Urban Development Department, Mantralaya, Mumbai, to the Secretary, Maharashtra Public Service Commission stating that in accordance with the notification dated 28.04.2017 of AICTE, the graduation qualification of Civil and Infrastructure Engineering is now considered equivalent to the degree of Civil Engineering. A copy of the letter dated 29.10.2024 is taken on record and marked 'X' for identification. Ms. Kapadiya would further submit that the MPSC would accordingly update the software for inclusion of the degree in Civil and Infrastructure Engineering on the portal. Petitioner can accordingly upload

This would meet grievance of the Petitioner in the present Petition. Accordingly, the Petitioner seeks leave to withdraw the Petition. Ms. Malik would submit that even the Original Application filed before the Tribunal would be withdrawn. The statement recorded.

The Writ Petition accordingly disposed off as withdrawn.
