Rao Gangadhar Krishnamurti v. Divisional Controller And ANR
13-WP-15505-2024 (C).doc IN THE HIGH COURT OF JUDICATURE AT BOMBAY CIRCUIT BENCH AT KOLHAPUR CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 15505 OF 2024 Rao Gangadhar Krishnamurti Vs.
Divisional Controller And Anr None for the petitioner Ms. Tejas Kapre, AGP for the respondent-State. CORAM : SMT. VIBHA KANKANWADI & NANDESH S. DESHPANDE, JJ.
DATE : 10th JUNE, 2026.
P. C. :
1.
None for the petitioner.
2.
The petitioner has come up with a case that he is doing business of running a ST canteen in Kurudwadi bus stand since 2021. The petitioner had taken the premises on lease from 01/03/2021 to 28/02/2026. He states that General Standing Committee order of respondent-State Transport Corporation governs the field. The respondent no. 2 has established the milk and dairy products shop in Kurudwadi bus stand. He changed the board of his shop on 04/06/2024 from 'Milk Products' to 'Snack Bar'. In fact, there was no order of permitting transformation issued by 1/2
13-WP-15505-2024 (C).doc respondent no. 1. The petitioner is already running a ST Canteen and the change of business by respondent no. 2 is causing loss to him. Hence, the petition.
3.
Though the petition was filed on 02/07/2024, it appears that it was not got for circulation. From pleadings of the petitioner himself, the period of lease has come to an end. It is in fact the prerogative of respondent no. 1 to give its premises on lease to any person. Merely because now there would be a commercial competition, the petitioner cannot invoke powers of this Court under Article 226 of the Constitution of India. 4.
The Writ Petition stands dismissed.
