1] Heard. The challenge raised in this writ petition is to the order dated 05/09/2024 passed by the Debts Recovery Appellate Tribunal by which the petitioner sought an interim direction to restore physical possession of the mortgaged property. The Debts Recovery Appellate Tribunal was of the view that since the Securitization Application preferred by the petitioner was pending before the Debts Recovery Tribunal, the grievance could be raised in the said proceedings. 2] We do not find any illegality committed by the Debts Recovery Appellate Tribunal when it passed the order dated 05/09/2024. By keeping all points on merits open for being raised by the Debts Recovery Tribunal, the writ petition is disposed of.
