After arguing the matter for some time, both the parties are agreed that the impugned judgment and order passed in Revision Application No. 13 of 2024 may be set aside, and the revision be directed to decide within three months. Hence, following order: ORDER:

(i) The impugned judgment and order dated 23rd September 2024 passed by the Principal District Judge, Pune in Civil Miscellaneous Application No.854 of 2024 is quashed and set aside.

(ii) The Principal District Judge, Pune shall decide the revision application within three months from the date of appearance of the parties.

75-wp-15762-2024.doc (iii) Parties shall appear before the Principal District Judge, Pune on 27th January 2025.

(iv) During pendency of the revision, the order of eviction passed against the petitioner shall not be sexecuted. 2.

The writ petition stands disposed of in above terms. No order as to costs.
