In view of the Division Bench Judgment of this Court in the case of Jagdish Pitambar Pawar v. Pitambar Pundalik Pawar and Ors. passed in Writ Petition No.36 of 2023, the learned counsel for the Petitioner fairly concedes the availability of an alternate remedy under Section 16 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and seeks permission to withdraw the present Petition with liberty to file an appropriate Appeal before the Appellate Authority.

In light of the above decision, the Petition is permitted to be withdrawn with liberty as prayed for.
