IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION CIVIL WRIT PETITION NO. 15909 OF 2024 Bharatratna Dr. Babasaheb Ambedkar Magasvargiya Krushi Prakriya Sahkari Sanstha Ltd.

... Petitioner V/s.

The State of Maharashtra & Ors.

... Respondents _______________________________________ Mr. Omkar Chavan h/f Mr. Nitin Gaware Patil for Petitioner. Ms. Kavita N. Solunke, Addl.G.P. a/w Mr. V.G. Badgujar, A.G.P. for Respondent-State.

_______________________________________ CORAM : A. S. GADKARI AND KAMAL KHATA, JJ.

DATE : 23rd March 2026 P.C. :

1) Advocate Mr. Chavan appeared for Petitioner and made a palpably false statement before this Court that, on last occasion we had permitted him to file rejoinder.

2) Perusal of record clearly indicates that, on at least last three occasions, Advocate for the Petitioner had simply sought an adjournment and none else.

2.1) Leave to file rejoinder was granted by Order dated 17th November 2025 and till date it is not filed on record. It is thus apparent that, 1/2

DTG 62-Wp-15909-2024.doc the Petitioner is seeking adjournment only for the sake of convenience and none else.

3) In view of the above, we gave an opportunity to Advocate Mr. Chavan to pay a reasonable cost and get the Petition adjourned, to which he did not accede and entered into bickering with the Court. It appears that, the Petitioner is not serious enough in pursuing the Petition. 3.1) We have therefore no other alternative than to dismiss the Petition in limine.

4) Petition is dismissed in limine.
