The Petitioners had to file this Petition only because the proposal dated 3.4.2023, pending with Respondent No. 3, has not been decided practically for 2 years. On account of the pendency of the proposal, the Petitioners from Sindhudurg had to prefer this Petition in Mumbai, only because Respondent No. 3 did not exercise the jurisdiction duly vested in him by law, expeditiously. We could have invoked our powers under The Maharashtra Government Servants Regulation of Transfers And Prevention of Delay in Discharge of Official Duties Act, 2005. However, the learned AGP prays that the order to commence an enquiry may not be passed.

In view of the above, on the condition that the Respondent No.3 Education Officer (Secondary), Zilla Parishad, Sindhudurg shall deposit an amount of Rs. 2500/- in this Court, we give a last opportunity to Respondent No. 3 to decide the said proposal within a period of 60 days from today. The amount shall be deposited in this Court from the salary bank account of Respondent No. 3, within 21 days and on the consent of the Petitioners, the same be donated to Poor Box Charity Fund, KEM Hospital, Mumbai, details of which are as below : Name : Poor Box Charity Fund, KEM Hospital, Mumbai. Account No. : 99350100000877.

Bank : Bank of Baroda.

Branch : Parel, Mumbai.

IFSC Code : BARB0BBPARE(5th Letter is Zero). 3.

Needless to state, if there are any deficiencies in the proposal, Respondent No. 3 would communicate the deficiencies to the Management within 15 days from today and grant an opportunity to the Management to remove the deficiencies.
