Respondent No. 3 - State Government, shall file an affidavit stating whether Village Wangan, Taluka Dahanu, falls within the area covered by the notifications attracting the provisions of the Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963 ("MOFA").

The petitioner has placed reliance upon the notifications dated 4 May 1987 and 10 June 1977, which do not mention Village Wangan, Taluka Dahanu. Therefore, the concerned officer on behalf of the State Government shall file an affidavit clarifying whether the provisions of MOFA are applicable to Village Wangan, Taluka Dahanu. The affidavit shall be filed within two weeks from today.
