5-WP-16733-2024-2.DOCX vs. Union of India and Anr.1, Mr. Odhekar, learned counsel on instructions seeks leave to withdraw this Petition with liberty to file appropriate application before the Additional Chief Metropolitan Magistrate, Esplanade, Mumbai where, the case is pending against the Petitioner.

Mr. Odhekar states that such application would be filed within a week from today. Upon its filing, we request the learned Additional Chief Metropolitan Magistrate to dispose of such application as expeditiously as possible and preferably within two weeks of its institution and service upon the Respondents. Further, the learned Additional Chief Metropolitan Magistrate need not be influenced by the showcause notice dated 6 December 2023 issued by the Regional Passport Office at Mumbai. Such application should be decided on merits in accordance with law.

With the above directions, leave is granted to withdraw this Petition with liberty to file the application before the learned Metropolitan Magistrate.

This Petition is disposed of as withdrawn with liberty in the above terms.
