Issue involved in this writ petition is the legality of the order dated 13th September 2023 by which the respondent-authority declined to grant approval to the appointment of the petitioners and refused to issue Shalarth I.D. on the ground that their appointments were not made through Pavitra portal.

The learned counsel for the petitioners refers to the decision of this Court in Writ Petition No.10205 of 2024 (Kalyansing Indrasing Rajput and Others vs. The State of Maharashtra Through its Principal Secretary and Others) and the connected matters to submit that this is an admitted position that the Pavitra portal was not in operation till June, 2024.

In the order dated 23rd April 2025 passed in Writ Petition No.10205 of 2024 and connected matters, a coordinate bench of this Court issued directions to the Education Officer and Deputy Director of Education to grant approval for the appointment of the appointees in Writ Petition No.10205 of 2024 and connected Writ Petitions who were B.D.Pandit-SPS 1/2

2 63-WP-16853-24.doc also declined approval for a similar reason. Therefore, having regard to the fact that the Pavitral portal was not in operation till June, 2024, the respondent no.3 - Education Officer (Secondary), Zilla Parishad, Solapur could not have declined approval to the appointment of the petitioners and thus, the order dated 13th September 2023 has been rendered vulnerable and, accordingly, quashed. 4.

This writ petition succeeds to the extent that the respondent no.3 - Education Officer (Secondary) shall grant approval to the appointment of the petitioners as Shikshan Sevaks subject to the petitioners' fulfilling the other conditions. 5.
