Learned counsel for respondent no. 2 pointed out that the petitioner had filed a similar writ petition before the Nagpur Bench of this Court, which the petitioner had withdrawn on 13th August 2024 without seeking any liberty. Therefore, the instant writ petition cannot be entertained. In support of her submission, reliance has been placed on a decision of the Supreme Court in the case of Sarguja Transport Service vs. State Transport Appellate Tribunal, M. P., Gwalior &Ors.1 (1987) 1 SCC 5

In view of the aforesaid submission, learned counsel for the petitioner prays for accommodation to enable him to seek clarification/modification of the order dated 13th August 2024 passed in Writ Petition No. 4692 of 2023.
