These are the Petitioners who had participated in the selection process conducted by the Recruitment Board, CISF ISP, Nashik.

In the physical test, their chest measurements were less than the requisite/ prescribed measurements, by one or two centimeters. Their contention is that last year they had appeared for a similar examination conducted by the same Department and that time, their chest had measured upto to the required parameters. One year down the line, the measurements indicate that they are short by one or two centimeters.

Having heard the learned Advocates for the respective sides, we are of the view that it is not within our domain to consider this disputed aspect of the measurement of chests. In such matters of physical test, this Court cannot exercise its Writ jurisdiction for considering disputed aspects.

It is further submitted that there is a provision to prefer an Appeal, but within one day of the test, if any candidate has a grievance. Petitioner Nos. 1, 4 and 11 preferred their Appeals within one day. The said Appeals are pending with Respondent No.3. 5.
If the Appeals are pending, we are directing Respondent No.3 to deal with the said appeals and pass an appropriate order within ten days from today.

In view of the above directions, this Writ Petition is disposed off.
