It is the Petitioners' case that they are the legal heir of Bapu Laxman Chavan, who was the owner of the land situated in Survey No.3/2 and 4/2, situated at village Kargaon, Taluka Jalwali, District Satara. Learned counsel for the Petitioners submitted that the said lands were acquired for Koyna project. No alternate land was given to Bapu Laxman Chavan or his legal 1/3

heirs. The Petitioners made an application on 27th July, 2018 before the Additional Collector, Raigad.

Learned counsel for the Petitioners submitted that there was correspondence between the Additional Collector Raigad and the Collector Satara. Till date, the Petitioners' application is not yet decided. It is quite obvious that the Petitioners' application is pending for quite some time. Least that was expected was that the Additional Collector, Raigad should have passed some order on the application.

Therefore, we are inclined to direct the Additional Collector, Raigad to decide the said application within a reasonable time.

Hence the following order :- i).

The Additional Collector, Raigad shall decide the Petitioners' application dated 27th July, 2018 within a period of three months from today strictly in accordance with law. 2/3

ii).

We make it clear that we have not made any observations regarding the entitlement of the Petitioners to have an alternate land. The issue is strictly left to the decision of the Authorities at this stage.

The Writ Petition is disposed off.
