ORAL JUDGMENT : { Per A.S. Chandurkar, J. } 1.

Rule. Rule made returnable forthwith. Considering similar prayers made in both these writ petitions, they are being disposed of by this common judgment.

All the Petitioners are conducting schools for specially enabled children and seek release of grant-in-aid from the Department of Social Justice and Special Assistance. They have made an application dated 10th August 2024 seeking release of such grants in terms of the then prevailing policy. Since their request has not been considered, they have filed the present writ petitions.

In Writ Petition No.17318 of 2024, affidavit-in-reply has been filed on behalf of the Respondent no.1 wherein it is stated that on 16th July 2024 the State Government has framed a new policy in the matter of releasing grant-in-aid for such schools. It is further stated that since the petitioners' application has been made prior to this policy coming into force, that request cannot be considered as per the earlier policy. Instead, if fresh applications are made by the petitioners, the same would be considered in accordance with the policy dated 16th July 2024. In the light of the aforesaid, the learned counsel for the petitioners seeks leave to make fresh applications to seek benefit of the Government Resolution 2/3

dated 16th July 2024.

Accordingly, if the petitioners make such application to the Respondent nos.1 and 2 within a period of two weeks from today, the same shall be considered in accordance with the prevailing policy dated 16th July 2024. A decision thereon be taken within a period of three months of receiving said applications by a reasoned order and the same be communicated to the Petitioners.
