Learned counsel appearing for the petitioner submits that the judgment of the Trial Court dated 22nd December, 2011 directing the present petitioner and others to execute Deed of Conveyance in favor of the plaintiff-society is stayed in first appeal proceedings by this Court on 12th March, 2013. He would further submit that subsequently in the year 2019, the Society has filed the suit seeking a declaration that the conveyance in favor of third party is not binding on the plaintiff-society. He would therefore, submit that there is already conveyance of the property which was not disclosed at the time of passing the order of deemed conveyance.
