The learned Member of the MRT by setting aside the order of the Tehsildar, ALT and SDO in proceedings under Section 32-G has remanded the matter for fresh consideration at the instance of the Respondent No. 1 who claims to be the legal heir of the original tenant in respect of the Gat No. 68/6.

Learned Counsel appearing for the Petitioner would submit that 32-G proceedings in respect of Gat No. 61/2 have already fructified in favour of the Petitioner and 32-M certificate has also been received and thereafter in respect of 68/6 when the proceedings were initiated the Respondent No. 1 had intervened though they are not the residents of the same village.
