Shri Walawalkar, the learned advocate for respondent No.1 made an attempt to justify why the committee has not been appointed under Statute No. 216(A) of the Shivaji University Act, 1974 to conduct preliminary enquiry against respondent no. 2. However, we find it is the statutory obligation on the part of the University to appoint the committee. We, therefore, direct respondent no.1 to appoint a committee as per request letter dated 07/10/2023 and reminder dated 11/03/2024 under Statute No. 216(A) of the Shivaji University Act, 1974 to conduct preliminary enquiry against respondent no. 2 within a period of 4 weeks from today.
