This petition can be disposed of by directing Education Officer (Secondary), Zilla Parishad, Raigad to treat the impugned order dated 01/03/2024 as a show cause notice. Learned counsel for the petitioners submits that had an opportunity been given to the petitioners, the deficiencies indicated in the impugned order could have been rectified.

In this view of the matter, we propose to take the view that the impugned order dated 01/03/2024 be treated as a show cause notice. The petitioners to respond to the show cause notice within a period of 2 Ingale
19-wp-17518-24.odt weeks from today and cure the defects/respond to the deficiencies within a period of 4 weeks thereafter. If necessary, upon hearing the petitioners, Education Officer to take appropriate decision on the show cause notice in accordance with law.

The writ petition is disposed of.

Mr. Bhavake at this stage submits that in case the approval is granted, the institution be directed to submit a proposal to the Deputy Director for Shalarth ID At this stage, we are not inclined to make any observation on this aspect as issue whether grant of approval or not based on the proposal is pending consideration before the Education Officer. Depending upon the outcome, it is obvious that the consequences will follow. The Education Officer not to be influenced by the observations made in this order and the matter be decided on its own merits in accordance with law.
