Heard Mr. Tripathi, learned Counsel appearing for the Petitioners. 2.

By the present Writ Petition filed under Article 227 of the Constitution of India, the Petitioners are challenging the legality and validity of the Order dated 23rd July 2024 passed below Exhibit-32 in RAE Suit No.1042 of 2023, by which the Application seeking amendment in the plaint has been allowed.

After arguing the matter for some time, Mr. Tripathi, learned Counsel for the Petitioners, seeks withdrawal of the Writ Petition with liberty to raise the contentions which are raised in this Writ Petition, in Appeal, if required to be filed, in case ultimately the said Suit is decreed in favour of the Respondent i.e. Original Plaintiff.

Accordingly, the Writ Petition is allowed to be withdrawn and disposed of as such, subject to above.
