The petition arises out of rejection of the nomination papers. The election is already over. Hence, the appropriate remedy for the petitioner is to challenge the election by way of dispute U/s.91 of the MCS Act.

The petition is, therefore, disposed of by keeping all the contentions raised by the petitioner open to be agitated in the election petition.
