Heard the strenuous submissions of the learned Advocate for the Petitioners and the learned AGP.

Petitioner No. 1 was appointed as a Shikshan Sevak without the TET/CTET qualification, on 1st March, 2016. He cleared the CTET qualification on 3rd March, 2023. The Education Officer granted an approval vide order dated 4th January, 2024 w.e.f from 3rd March, 2023. 3.
In several orders, we have concluded that since the issue as to whether the TET would be a necessary requisite, is before the Hon'ble Harish
26-WP-18029-2024.odt Supreme Court in a batch of Petitions. A decision is expected as to whether TET would be a compulsory requisite and whether it has to be acquired prior to the cut-off date 31st March, 2019. In such circumstances, we have granted conditional approval subject to tendering of an Affidavit undertaking, in view of the orders passed in Writ Petition No.11121 of 2023 (Dattatry Devidas Sonwale And Another V/s. The State of Maharashtra Through Its Principal Secretary And Others) and in Writ Petition No.16423 of 2023 and other connected matters (Stephie Sushant Ransing Alias Stephie Sebastian John V/s. The State of Maharashtra and Ors.).

In view of the above, for the present, we have not interfering with the impugned order since the same is in tune with the verdict of this Court. Needless to state, if the Hon'ble Supreme Court concludes that either the TET is not compulsory or whether the cut-off date is to be relaxed and if the Petitioner gains any benefit out of the said order, liberty to renew the request for seeking service benefits. 5.
With the above observations, this Writ Petition is disposed off.
