It appears that there is difference of opinion between the members of Consumer Grievance Redressal Forum. While two members have directed refund of the entire amount holding that Respondent No.2 is not liable to pay difference in tariff in respect of the entire period from February 2014 to May 2022, the third Member has given independent opinion relying on provisions of Section 56(2) of the Electricity Act, 2003 under which recoveries are permissible in respect of past arrears upto 24 months. The third member has thus opined that difference in the electricity charges can be recovered from Respondent No.2 in respect of period of 24 months.

It appears that the majority decision directs recovery of differential amount from the employees of the Petitioner, which is yet another reason for filing of the present Petition. 3.

Issue notice to Respondent No.2, returnable on 30 June 2025.
