In Writ Petition No. 12906 of 2024, a Learned Single Judge of this Court, by order dated September 12, 2024, has stayed the Impugned Order. That protection has continued till today. 2.

Learned Advocate for the Petitioner points out that, apart from 21 Second Appeals of the Petitioner having been decided on the same day, the order imposing the penalty is vague to the extent that it does not even identify the purported interim direction issued to the

Petitioner, the non-compliance with which was visited with a penalty. He also submits that hearings in the case of 16 Second Appeals were cancelled, but final orders imposing penalty have been issued. 3.

Learned AGP on behalf of the Commission submits that there is a clear explanation and, merely because multiple appeals were decided in one day, it would not mean that the orders are untenable in law.

It would be appropriate to call for an affidavit by a Senior Official of the Commission setting out the factual matrix, and in particular bringing on record the order passed in the course of the hearing, the non-compliance with which has led to a penalty. Let such order also be brought on record in the affidavit and reply. Let such reply be filed no later than February 26, 2026. Rejoinder, if any, shall be filed before the next date.

The interim arrangements, if any, obtaining as of today, shall continue until the next date.

As regards the Writ Petition No. 18351 of 2024, while the dates and the content may vary, the principle involved is the same. The

directions as aforesaid shall also be applicable to Writ Petition No. 18351 of 2024.

List both the Petitions on March 04, 2026.

All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website.
