After the matter was argued for some time and considering that a statutory appeal is permitted under Section 33 of the Maharashtra Police Act, 1951, and such appeal was rejected solely on the ground that a formal application for condonation of delay was not made, it is considered appropriate to condone the delay in filing the appeal, in exercise of this Court's powers. The Appeal is restored to the docket of the Appellate Authority.

The Appellate Authority shall hear the Appeal as expeditiously as possible and preferably within a period of eight weeks from the date of Digitally signed by AARTI GAJANAN PALKAR Date:

No comment is made on the merits of the matter, and the Appellate Authority shall hear the Appeal uninfluenced by past proceedings and shall restrict the consideration to the merits of the show-cause notice for the violations.

The Petitioner shall appear before the Appellate Authority no later than 12 noon on February 13, 2026, on which date the Appellate Authority shall give instructions on how to proceed with the matter. 5.

All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website.
