The Petitioner has preferred this Petition seeking a direction to the Zilla Parishad to consider him for the post of Pharmacy Officer in terms of the Advertisement No. 01/2023. The Petitioner claims that he has applied pursuant to the Advertisement, has participated in the selection process and now he is listed at Serial No. 1 in the waiting list. According to him, one post of Ex-Serviceman has not been filled in and that may be made available to the open category for the general candidate.

The Petitioner submits that after the filing of this Petition, the Chief Executive Officer, Zilla Parishad, Nashik has issued a
Trupti 2 43-18693-2024.odt communication dated 12th December, 2024 informing all the concerned that whenever a candidate belonging to the Ex-Serviceman category is not found to be eligible and the post is vacant, the said post must be considered as under :

The above stated communication is taken on record and marked as 'X' for identification.

In view of the above, this Writ Petition is disposed off. 5.
If the Zilla Parishad, Nashik finds that the Petitioner, who is claimed to be wait listed at Serial No.1, is eligible in the light of the above reproduced direction, he may be considered. 6.
We make it clear that we have not expressed any opinion as regards the claim of the Petitioner, inasmuch as, we have not formed the view that he is eligible.
