Heard the learned Counsel for the Petitioner. 2.

Learned Counsel for the Petitioner invited attention of the Court to an order dated 25 August 2024 passed by the learned Judge, City Civil Court directing the Plaintiff to address the Court on the maintainability of the suit without claiming substantive relief. Learned Counsel also invited attention of the Court to the prayer clauses in the plaint. 3.

Learned Counsel for the Petitioner submitted that the Plaintiff is willing to advance arguments and satisfy the Court about the maintainability of the suit. However, as the Plaintiff is not heard on the preliminary points, the Notice of Motion filed by the Plaintiff is not being taken up for hearing. The Court is informed that the suit is now posted for hearing on 24 April 2025. 4.

Learned Judge, City Civil Court, is requested to hear the Plaintiff on 24 April 2025 and pass appropriate orders.
