Heard the learned Counsel for the petitioners. 2.

The petition assails an order of 10th July 2024 passed by the learned Civil Judge, Senior Division, Barshi, whereby witness summons has been ordered to be issued to the bank in which the deceased had allegedly maintained a deposit.

The learned counsel for the petitioner submits that the witness summons was not required to be issued as the said witness was not named in the list of witnesses. The Trial Court has issued the witness summons on the premise that, it is necessary to ascertain the amount laying to the credit of the account of the deceased. 1/2

Such an order does not warrant interference in exercise of writ jurisdiction.
