The challenge raised in this Writ Petition is to an interim order dated 20th December 2024 passed by the Maharashtra Administrative Tribunal, Mumbai ('Tribunal') in four Original Applications preferred by the Petitioners. The Petitioners were seeking age relaxation for participating in the recruitment process, by virtue of Government Resolution dated 3rd March 2023. The Tribunal refused to grant any interim relief. Aggrieved thereby, the Petitioners have approached this Court. 2.

We find that as a challenge has been raised to an interlocutory order, it would be fitness of the things that the Gaikwad RD 1/3

Original Applications pending before the Maharashtra Administrative Tribunal are decided finally on merits. This would enable the Petitioners to be aware of the position as to whether they are entitled to participate in the recruitment process or not, on the basis of their prayer for grant of age relaxation. 3.

In view of the aforesaid, the following order is passed:

ORDER

(i) Original Application Nos.1160 of 2024, 1232 of 2023, 1245 of 2024, 1183 of 2024 and Miscellaneous Application Nos.472 of 2024, 593 of 2024 & 492 of 2024 that are pending before the Maharashtra Administrative Tribunal shall be decided expeditiously and preferably by the end of September 2025.

(ii) It is clarified that all contentions of the parties are kept open. The Tribunal shall not be influenced by the observations made in its interim order dated 20th December 2024 and all contentions be considered on their own merits.

With the aforesaid directions, the Writ Petition is disposed of.
