It has been informed by learned Special Counsel representing the State that pursuant to the subject tender, work order has been issued.

At this juncture, learned counsel for the petitioner seeks liberty to challenge the work order and implead the party in whose favour the work order has been issued.

Liberty as prayed for is granted. Let the necessary amendment be incorporated by the learned counsel for the petitioner during the course of the day. Re-verification is dispensed with.

Issue notice to the newly impleaded respondent no. 3, returnable on 22nd January 2025. To be listed High on Board. 5.
Hamdast permitted. It will be open to the learned counsel for the petitioner to serve the newly impleaded respondent no. 3 by all other permissible means.

Pursuant to our order dated 2nd January 2025, the test report has been provided by the learned AGP to the learned counsel for the petitioner. It has been stated by learned counsel for the petitioner that the test report shows various discrepancies.

Accordingly, as prayed by learned counsel for the petitioner, four days' time is granted to him to file an additional affidavit enclosing therewith the inspection/test report as also raising the objection to the same. Affidavit in reply to the said additional affidavit shall be filed by the learned Special Counsel by the returnable date.
