Petitioners impugn order dated 21st June 2024 passed by Respondent Nos.3-Sub Divisional Officer, Vita in Review Application RTS/Review/1618(3)/2023.

Learned counsel appearing for Petitioners submits that Petitioners have filed an Appeal bearing No.297 of 2024 before Additional District Collector, Sangli against impugned order. However, learned Additional District Collector, Sangli, refused to entertain Appeal on the ground that Sub-Divisional Officer had passed order on Review as per permission granted by District Collector u/s 258 of Maharashtra Land Revenue Code. Apparently, reason recorded in order dated 26th August 2024 by Additional Suresh 1/2

57-WP-19425-2024.doc District Collector appears to be erroneous.

Although, learned District Collector had granted permission to take a review u/S 258 of of Maharashtra Land Revenue Code and learned Sub-Divisional Officer has reviewed order, powers of learned Additional District Collector to entertain an Appeal against order passed on review cannot be taken away. The grant of permission to take up review by District Collector would not be an impediment to entertain appeal, which is statutory remedy made available to the aggrieved person.

In that view of the matter, present Writ Petition stands disposed of, thereby setting aside order dated 26th August 2024 passed by Additional District Collector, Sangli, with a further direction to register Appeal filed by Petitioners and decide same on its own merits.

All contentions raised in Writ Petitions are kept open. 7.

The Petitioners to appear before learned Additional Collector on 22nd September 2025.
