Mr Gorwadkar, points out that just yesterday, 09 January 2025 the Petitioners were served with communication dated 6 January 2024 (by speed post) informing them that an award has been made on 22 March 2024 in the matter of acquisition of the Petitioner's land.

Accordingly, on instructions, Mr Gorwadkar seeks leave to withdraw this Petition with liberty to challenge the communication dated 6 January 2024, the award and all
911.WP.19509-2024.DOCX other notices concerning the acquisition of the Petitioner's property.

Leave is granted with liberty as prayed for. We clarify that all contentions of all parties are explicitly left open. At the request of Mr Gorwadkar, we record that even the challenges raised in this Petition are left open because we have not examined such challenges on merits.

Ms Crasto and Mr Vijay Patil, the learned Counsel for the Respondents point out that there is a typographical error in the communication dated 6 January 2024 in as much as the award was made on 2 January 2025 and not on 22 March 2024.

Since we are only allowing the withdrawal of this Petition with liberty, this issue is not quite relevant at this stage.

Accordingly, this Petition is disposed of as withdrawn with liberty in the above terms. There should be no order for cost. All concerned to act on an authenticated copy of this order.
