IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION First Appeal No. 571 of 2024 Bajaj Allianz General Insurance Co. Ltd.
...
Appellants V/s.
Alka Vijay Chautray & anr.
...
Respondents Mr. Sarthak Diwan Advocate for the Appellants.
Mr. Vasant N. More Advocate for the Respondents.
CORAM : S.M. MODAK, J DATE : 6th October 2025.
P.C. :
Heard Mr. Diwan for the Appellant-Insurance Company and learned Advocate More for Claimant-Respondents. 2.
The Award is in a injury claim petition. Apart from the other grounds, Mr. Diwan is heavily relying upon the entitlement of the injured to claim compensation by applying the test of the future loss of income particularly after obtaining VRS. He invited my attention to the calculation in Para No.43 and the findings given in Para No.40 about VRS. The Tribunal observed as follows: LATA SUNIL PANJWANI "In such disability she cannot continue her job and the LATA SUNIL PANJWANI Date: 2025.10.07 11:48:04 +0530 reason of VRS found justified though it has not mentioned in VRS."
LSP 2 3 fa 571.24.doc 3.
According to him in fact the injured was cross-examined at length about the reason for obtaining the VRS and nothing has come in her evidence that she took VRS due to disability. 4.
Stand over to 10th October 2025.
