2) Present Application filed by the Respondent No.1/Original Claimant seeking permission to withdraw the entire compensation amount alongwith accrued interest.
3) Mr. Gatne, the learned Advocate for the Applicant opposed the Application. However, he stated that, there is no statutory defence in this case.
4) The prayer for withdrawal of compensation amount is based on the ground that, the Applicant is economically poor. Her husband is blind. Therefore, the Applicant is in need of the compensation money. 5) In view thereof and considering other grounds stated in the Application, the Applicant is permitted to withdraw Rs.2,25,000/- out of the compensation amount alongwith accrued interest subject to furnishing usual undertaking that in case the Appellant succeeds in this Appeal, the Applicant would refund the said amount alongwith interest as would be directed by this Court. The Tribunal shall invest remaining amount with nationalized bank giving highest interest from time to time. 6) Interim Application stands disposed of.
