Learned counsel for the Appellants submits that in view of the decision of the Apex Court in the case of Clarence Pais And Ors vs. Union of India [(2001) 4 SCC 325] and in view of Section 213 and 57 of the Indian Succession Act, as the property forming subject matter of Will is situated in Nasik, there is no requirement for obtaining probate.
