Mr. Mehta, the learned Advocate for the Appellant states that, the execution proceedings arising out of the Judgment and Order impugned herein, has been amicably settled between the parties before Motor Accident Claims Tribunal, Nashik. Therefore, Mr. Mehta, on instructions, seeks leave to withdraw the aforesaid Appeal and tendered photocopy of the said settlement. Said photocopy of the settlement is taken on record and marked as Exhibit "X" for identification. 2) Leave to withdraw is granted.

3) Appeal stands disposed of as withdrawn.

4) The amount of statutory deposit shall be transferred to Motor Accident Claims Tribunal, Nashik.
