According to learned Advocate for the Appellant Insurance Company, the Claimant was a pillion rider and there was an "Act Policy" and as such, such pillion rider is not covered by such policy (ground No.B of the Appeal memo). Whereas according to Mr.More, this ground was not taken in the written statement filed before the Tribunal.
