The Appeal from Order impugns an order dated 6th January 2024 passed by the Trial Court in Notice of Motion No. 43 of 2021, whereunder the Trial Court was pleased to dismiss the said Motion. By consent of the parties, the Appeal from Order is agreed to be disposed of in terms of the following order:

::ORDER::

(i) The Respondent/original Defendant nos. 1(a) and 1(b) shall not alienate, encumber or create any third-party right, title or interest in the suit premises being Flat No. B/12 situated on the 2nd Floor of "Aditya Part" CHS. Ltd., C. S. Road, Dahisar (E), Mumbai pending the hearing and final ------------------------------------- Order dated 9th April 2026

44. AO/270/2024 Vivek vs. Namrata disposal of Suit No. 1446 of 2020.

(ii) The Appeal from Order is disposed of in terms of the aforesaid order with no order as to costs.

(iii) The parties state that the suit is at the stage of evidence. Considering this and keeping in mind that the Plaintiff no. 2 is a senior citizen, the Trial Court is requested to dispose of the said suit as expeditiously as possible and in any event, on or before 30th June 2027.
