Heard learned counsel for the parties finally. 2.

Respondent Nos. 4 and 5 are the only contesting Respondents at whose instance, the suit for partition is pending against the Appellant in the City Civil Court at Dindoshi, Borivali Division, Goregaon in which there is interim injunction granted against the Appellant. 3.

The appeal memo itself indicates that Respondent No.6 to 17 are only proforma Respondents and the Appellant is not claiming any relief against them.
