The present Interim Application has been preferred by the Applicant/Original Plaintiff seeking recall and setting aside of the order dated 13th January 2026 which dismissed the Appeal and pending Interim Applications for non-prosecution.

I have heard the parties and perused the averments contained in the said Interim Application and I am satisfied with the reasons that are set out ------------------------------------- Order dated 28th April 2026.

Accordingly, the said Interim Application is disposed of in terms of the following order :- : : ORDER : :

(i) Subject to the Applicant making payment of a sum of Rs. 15,000/- to Tata Memorial Hospital, Mumbai on or before 2 weeks i.e. 5th May 2026 and submitting proof of such payment with the Registry, the Appeal From Order No. 501 of 2024 and Interim Application No. 10222 of 2024 shall stand restored to the file of this Court.

Place the matter for compliance on 7th May 2026 under the caption 'High on Board'.
