After hearing the aforesaid Appeal for some time, learned counsel for the Appellant submitted that if the trial Court is directed to expedite the hearing and disposal of the subject draft Notice of Motion, he would not press this Appeal. Said statement is accepted. 2) In view thereof, the Appeal stands disposed of . 3) The learned Judge of the trial Court, i.e. City Civil Court, Dindoshi Division, Mumbai is requested to expedite the hearing and disposal of draft Notice of Motion in S. C. Suit No.1785 of 2024, if possible, without affecting cases requiring expeditious hearing and disposal. 1/2

5) It is made clear that this Court has not heard the aforesaid Appeal on merit.

6) All contentions of the parties are left to be adjudicated at the appropriate stage of the proceedings.
