Learned counsel for the Appellant made a statement that the 'Toilet Block' which is a subject matter of the Suit has been demolished and in its place a new Toilet Block is under construction as permitted/approved by Mumbai Slum Board, utilizing funds provided by the local MLA. 2) In view thereof, learned counsel for the Appellant seeks leave to withdraw the aforesaid Appeal.

3) Leave to withdraw.

4) Appeal stands disposed of as withdrawn.

5) It is made clear that the aforesaid statement made by learned counsel for the Appellant is subject to the record of the Respondents and relevant permissions to be obtained for the construction of such new Toilet Block.
