______________________ Mr.SS.Patwardhan i/b. Ms. Mrinal Shelar for the Appellants/Applicants.
Ms. Deepa Bhardvaj i/b. Mr. Bandre Gauri Sanjay a/w. Chandrakant Nanekar for the Respondents.
________________________ CORAM : Kamal Khata, J.
DATED : 4th November 2025.
P.C.:- 1.
Mr. Patwardhan submitted that this is a short matter and can be disposed of. Ms. Bhardvaj agreed and was ready to proceed with the matter.
2.
Having heard Mr. Patwardhan for some time when some questions were put to Ms. Bhardvaj she couldn't answer. She then submitted that she had instructions from Tikam
42-AO 767 OF 2024.DOC her senior, that her clients are desirous of exploring a settlement. On that basis, she seeks four weeks' time. 3.
Mr. Patwardhan submits that he has not received any instructions in this regard from his client.
4.
This conduct of the Advocate for the Respondents is unacceptable to the Court. It appears that the Respondents are merely seeking to delay the matter on the ground of proposed settlement. In my view, if the Respondents are indeed desirous of settling the matter, they shall forward a concrete proposal to the Appellants by 7th November, 2025. 5.
List the matter on 14th November, 2025 for directions. 6.
It is clarified that today's adjournment is granted solely on the submission made on behalf of the Respondents. If no proposal is forwarded by 7th November, 2025 and the matter proceeds on 14th November 2025, the Respondents shall be liable to pay costs of today's adjournment, which will be considered on the next date.
7.
Ad-interim relief, if granted, shall continue to operate till the next date.
