Learned counsel for the Appellant submits that considering the Order dated 28.11.2024 passed in this matter, the Appellant is not pressing the Appeal from Order; however, he prays that the suit as filed by the Appellant, be considered on its own merits without being influenced by the impugned order. He further prays that the suit be taken up for hearing as per its own turn.

In that view of the matter, Appeal from Order and pending interim application are disposed of by passing following order. a. The impugned order is not interfered with. b. The Trial Court will decide the subject suit on its own merits, in accordance with law, without being influenced by Husen
