The Appellant, appearing in person through video conferencing, submits that she has been unable to speak to her Advocate and give instructions on account of ill health. She accordingly seeks two to three months' time.

Mr. Godbole submits that this is a lame excuse advanced with an intent to delay the hearing of the Appeal and Contempt Petition as the structure sought to be protected during the pendency of the Appeal is illegal. He further submits that the Advocate has been appearing throughout in the matter and on the previous occasion (when he sought an adjournment) was informed that the matter will proceed today. Despite that the Advocate has chosen to remain absent.

It appears that the Appellant is attempting to avoid the hearing of the Appeal as well as Contempt Petition which were listed for hearing today.

As a final opportunity to the Appellant, to instruct this Advocate the matter is adjourned.

List the matter on 13th January 2026 for hearing of both the Appeal as well as Contempt Petition.

The Appellant as well as her Advocate are put to notice that if the Appellant remains unrepresented on the next date for any reason whatsoever, the Court shall proceed to hear Appeal and Contempt Petition ex parte.
