By an order dated 10th February 2026, this Court had imposed AMOL PREMNATH JADHAV costs on the Petitioner/Appellant which were required to be paid within four AMOL PREMNATH JADHAV Date: 2026.04.01 20:06:59 +0530 weeks from that date. On last occasion viz. on 30th March 2026, Mr. Tripathi, learned Counsel who appears for the Petitioner/Appellant had informed this Court that he has no instructions as to whether his client had in fact complied with the said order and made the payment. Considering this, an order was passed on 30th March 2026 directing the Petitioner/Appellant to remain present in Court today.

Despite such specific directions, the Petitioner/Appellant is not present in Court. Instead Mr. Tripathi, on instructions states that his client is suffering from some heart ailment which prevents her from attending Court. No documentary proof has been submitted to corroborate this assertion. Instead, Mr. Tripathi seeks to rely upon certain old documents that form part of earlier proceedings. This is entirely impermissible inasmuch as, when a specific order has been passed by this Court directing the Petitioner/Appellant to remain present, if the Petitioner/Appellant, seeks exemption on medical grounds from appearance in person, it was incumbent on her to file an Affidavit together with supporting documentary evidence seeking dispensation from appearance in person, of her personal presence. The same has admittedly not been done.

However, as and by way of a last chance, the Petitioner/Appellant is permitted to remain present in Court tomorrow at 11.00 am.
