After the matter was extensively argued by both the sides and when the Court was inclined to grant interim injunction in favor of the Appellants based on the material produced on record, Mr. Khandeparkar, learned Counsel appearing for the Respondents states on instructions that, Respondent No. 1 propriety firm - Teerth Developers through Mr. Vijay Tukaram Raundal will not create third party interest in the suit property either himself or through his agents, servants, assignees etc. during the pendency of the suit - Sp.C.S. No. 1078 of 2022. The statement is accepted as an undertaking to this Court.
