The Appeal is urgently moved because the Appellant has received notice from the employer of deceased-Chandrakant in respect of disbursement of post death service benefits.

The Appellant is the mother and Respondent No. 1 is wife of the deceased - Chandrakant. The Respondent Nos. 1 to 3 applied for succession certificate in which the present Appellant has raised a defence that she is entitled to the post death service benefits exclusively because the deceased - Chandrakant, during his lifetime, has corrected nomination form in service records and the Appellant (Mother) alone is nominated. akn 1/2

It appears from the records that the Respondent No. 1 had filed maintenance application against the deceased - Chandrakant and there was compromise between the parties.

The learned Counsel for the Appellant further submitted that the issue as regards entitlement of the married daughter of the deceased - Chandrakant (Respondent No. 2) to service-benefit is also involved. 6.

Issue notice to the Respondents, returnable on 25/07/2025. 7.

Till the next date, the order dated 14/03/2023 passed in Civil Misc. Application No. 27 of 2021 by Civil Judge, Sr. Division, Vaduj shall remain stayed.
